Overtime Rules Change
New and final Federal Regulations issued April 23, 2004 make significant changes in Overtime Pay Standards. They include new tests and income thresholds used to determine eligibility.
Employees now earning less than $23,600.00 annually ($455.00 per week) automatically qualify for overtime pay. The former standard was less than $8,060.00 annually ($155.00 per week). Moreover, this is a clear improvement over the first proposed change to $22,100.00 annually ($425.00 per week).
The upper limit has also changed. "Highly Compensated Employees" earning more than $100,000.00 are generally not eligible for overtime pay. The earlier proposal would have been set at $65,000.00.
