Brief Notes

The Courts and the Legislature keep giving us new law:

MONROE COUNTY: A store owner was not liable for negligence where a customer tripped over a large yellow warning sign on the floor. In a second case, a snow tuber who changed the release prior to riding was permitted to sue the operator of the resort.

LANCASTER COUNTY: A motorcycle driver riding on a racetrack cannot sue the tract for running into a maintenance tractor since he signed a liability release.

PHILADELPHIA COUNTY: A potbellied pig is deemed to be a farm animal and not a pet and therefore, could not be kept in a residence. Another court in that county held that an airplane landing strip is not a permitted accessory use for a single-family residence.

LUZERNE COUNTY: The maternal grandmother may petition to terminate father's parental rights where the father killed the mother and the father is serving life without possibility of parole for murder.

THE TAX COURT: Has ruled that a casual gambler had to report winnings despite larger losses.

THE PENNSYLVANIA SUPERIOR COURT: Has held that a telemarketer selling cremation packages was ordered to cease because it was not licensed to provide funeral services in Pennsylvania.

NEW PENNSYLVANIA LAWS: Act 43 of 2005 provides for children to provide financial support for indigent parents where the child has the ability to do so.

Act 63 of 2005 makes computer-assisted hunting illegal in Pennsylvania.

Act 85 of 2005 deals with paint ball guns. It sets requirements for transportation of paint ball guns and makes it unlawful to discharge them at persons who are not involved in paint ball games, and makes it a criminal offense for defacing property with a paint ball gun.
